These Terms and Conditions establish the rules that regulate the access, use and contracting of services through ACTVREACH www.actvreach.com (hereinafter, “ACTVREACH”), property of SEVENN MARKETING DIGITAL, S.A. DE C.V. (hereinafter, “the Company”), with address at Avenida Insurgentes Sur, N°933, INT 102 Piso 1, Colonia Nápoles, Alcaldía Benito Juárez, C.P. 03810 , Ciudad de México. These provisions are applicable to any person who accesses, browses and/or contracts the services offered in ACTVREACH (hereinafter, “the User”).

Access, use, and/or acquisition of services through ACTVREACH implies prior reading, understanding, and express and unreserved acceptance of the entire contents of this document. If the User does not agree, in whole or in part, with any of its provisions, they must refrain from using ACTVREACH and from contracting any of the services offered herein.

I. Object

The purpose of this document is to regulate the conditions under which the Company makes ACTVREACH available to the User and the services offered therein, as well as to establish the rights, obligations, and responsibilities that arise for both parties. Access to the site does not, in itself, imply the existence of a contractual relationship between the Company and the User, unless the latter formalizes the contract for a service following the procedure established for this purpose.

II. Conditions of access

The User represents and guarantees that they have sufficient legal capacity to enter into contracts under Mexican law. Use of the site by minors must be carried out under the supervision of a parent or legal guardian, who will assume responsibility for any actions taken by the minor. The Company reserves the right to deny, suspend, or cancel access to the site and/or the contracted services if it detects fraudulent, illegal, or activity that violates the provisions of these Terms and Conditions.

III. Contracting of services

1. The service contracting process will be considered complete only when the User has completed the online application form, made the corresponding payment through the authorized means, and received a purchase confirmation sent by the Company to the registered email address.
2. The Company reserves the right to modify, update, or delete at any time the information, features, prices, and availability of the services offered, always respecting the conditions in force for contracts already formalized.
3. The User acknowledges that the contracting of services is subject to availability and that, in some cases, it may be necessary to establish specific additional agreements for their execution.

IV. Prices and payment methods

1. All prices published on the site are expressed in local currency (MXN) and include applicable taxes, unless otherwise indicated.
2. Payment for services can be made via online payment.
3. The Company will not store complete bank card data, as payment processing is handled by certified third-party providers that comply with PCI DSS security standards. The User acknowledges and accepts that these providers will be responsible for processing the banking information provided when making the payment.

V. Permitted Use of the Site

The User agrees to use ACTVREACH and all of its content lawfully and in compliance with applicable law, good faith, morality, and public order. The following are strictly prohibited:

1. Alter or modify, in whole or in part, ACTVREACH or its content without the Company's prior written authorization.
2. Introduce viruses, malware, or any malicious code that may damage, disrupt, or interfere with the normal operation of the site.
3. Use the contents and materials of the site for unauthorized commercial purposes or for the benefit of third parties without the express consent of the Company.

VI. Intellectual property

All elements of ACTVREACH, including text, images, logos, trademarks, trade names, graphic designs, source code, and other materials, are the exclusive property of the Company or third parties that have granted the corresponding licenses. The User does not acquire any rights to these elements by merely using the site or contracting services, and their reproduction, distribution, transmission, modification, or unauthorized use is prohibited.

VII. Limitation of liability

The Company will use its best efforts to maintain the continuous and secure operation of the Site, but does not guarantee the absence of interruptions or technical errors. The User agrees that use of the Site is at his or her own risk and that the Company will not be liable for any direct, indirect, incidental, or consequential damages that may arise from access to, use of, or inability to use the Site or the Services.

VIII. Cancellations and refunds

Cancellation and/or refund requests will be governed by the Refund and Return Policy available at ACTVREACH, which forms an integral part of these Terms and Conditions.

IX. Jurisdiction and applicable law

This document is governed by the laws of the United Mexican States. For the interpretation and enforcement of the provisions herein, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may apply to them by reason of their present or future domicile.
